Law enforcement officers are required to review the following guidelines and be cautious so that they are not accused of racial profiling. The world is watching to see how Arizona enforces Senate bill 1070, and so it is with great importance that these guidelines are met.
FOR ANY LAWFUL CONTACT MADE BY A LAW ENFORCEMENT OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR OTHER POLITICAL SUBDIVISION OF THIS STATE WHERE REASONABLE SUSPICION EXISTS THAT THE PERSON IS AN ALIEN WHO IS UNLAWFULLY PRESENT IN THE UNITED STATES, A REASONABLE ATTEMPT SHALL BE MADE, WHEN PRACTICABLE, TO DETERMINE THE IMMIGRATION STATUS OF THE PERSON. THE PERSON’S IMMIGRATION STATUS SHALL BE VERIFIED WITH THE FEDERAL GOVERNMENT PURSUANT TO 8 UNITED STATES CODE SECTION 1373(c).
What is reasonable suspicion?
An individual may only be questioned if there is reasonable suspicion that they have committed or plan to commit a criminal act. SB1070 makes it a criminal offense to be in the State of Arizona illegally. See how that works? Therefore, if you suspect that an individual is here illegally, then you must question their citizenship status and follow code 1373(c).
How can I visually tell if an individual is here illegally?
The State of Arizona will not tolerate racial profiling. You may not question any individual because they look to be of Mexican descent. However, law enforcement may use any one of the following leading questions during a public stop:
- Is this your 1980′s-era Buick/Cadillac/Oldsmobile Cutlas Supreme?
- Are those tires rented?
- Are all five of these children yours?
- Exactly what do you plan to clean today with all that lavender scented Fabuloso?
- Your boots look pretty muddy, working in the herb garden again?
- Do you support Senate Bill 1070?**
Where can I detain large groups of suspects at once?
Illegal immigrants are currently 43% of the total population of the State of Arizona. Therefore great care should be taken to make the most of our public funds and make as few stops as possible while still maintaining detention quotas for your department.* The following locations should be checked at least once per day:
- The parking lots of Walmart, Home Depot and Kmart.
- 24 hour restaurants that end in -berto’s.
- Ranch Market, Food City and most dollar stores.
- Any tire rental outlet.
- The lushly landscaped yards of Phoenix-area suburbs.
*Note, if Proposition 100 passes then we will double funding for enforcement of this program. Additionally, your department will receive another one thousand dollars per year every time you publicly call the proposition a “revenue enhancement” instead of a tax.
**Those who claim support for Senate Bill 1070, and those who do not, should be asked to sign standard petition form 3(c) and 3(d), respectively.

Mexican isn’t a race, it is a nationality, just like being Canadian is. Since most illegals are from Mexico, people appearing to be from Mexico are the people we need to be asking questions to. I can understand that desperate times call for desperate measures. When crime and violence is spilling over onto US grounds and the Government who is sworn to protect us under the Constitution fails to do so, then each state is left with nothing to do, but attempt to protect it’s own borders. This may not be the best law to pass, but it’s a start to a disturbing problem. I applaude the efforts that are being made by our border Governors. With their hands tied by the US Government, there is only to make laws that protect the citizens of these border states. I believe that the Border Governors Conference is a great way to work with Mexico and the border States on controlling the ever so growing problem that we face. I just hope that by the passing of this Senate Bill 1070 in Arizona, we don’t make this a “witch hunt.” There are ways to protecting our borders, we just have to find the best possible solutions. We have to trust those elected officials in office that they are going to do what is best for our Country and for our Border States. If anybody has better ideas…and realistic ideas, then they should write their perspective Governors and share those ideas. Afterall, they are the ones that can make things happen. Let’s hope that the Obama Administration realizes that this IS a real problem and takes some sort of action to control it instead of telling our Border Governors that 250 Federally paid National Guardsmen are enough to control this issue.

I believe SB 1070 is helping Arizona. My grandfather had to wait 25 years in mexico to get his VISA so you could come visit the US and i don’t think it’s right for someone to just hop-on over. It is NOT racial profiling to mexicans, and if an officer asks you what you are going to due with that lavender scented fabuloso or whatever and you take it up the butt, well then you have the right to report it. I think peoples should do some research before they post anything. the U.S. has tried to deport mexicans twice already. first during the great depression with the mexican repatriation act which deported hundreds of thousands of mexicans 60% of them american citizens and it did nothing to change unemployment rates. this was done again without any results with operation wetback after WWII. now once again the gov’t is trying a tactic that has failed twice already. did you even know that private prisons helped pass this bill because crime rate was declining and they were losing money. and for anyone who doesnt think this bill is discriminatory you need to open your eyes. i am mexican but light skinned and my father is dark skinned and legal. when we were passing through arizona we got stopped twice within thirty minutes. although we were not asked any of these ridiculous questions they checked my fathers papers but not mine and didnt even believe i was his son because of the color of our skin. if this is not racial profiling then i dont know what is. there have been many studies about immigration and almost all of them show that immigrants do not affect employment rate. one study showed that high immigration actually increases employment rates. im not saying immigration doesnt bring problems, sure there is some crime but crimes are not committed by only immigrants there are those bad people in every race whether they be white, mexican, black, asian, etc you name it. but you have to understand that crime is going to happen no matter what and that it isnt caused just by one group of people. these immigrants come to a country founded by immigrants to make a better life for themselves and their families. the U.S. has been trying to blame others for their problems since the beginning of the century so that the american people can focus their anger somewhere else. all i am asking is that people educate themselves and not be fooled by what politicians say. you need to know the facts on both sides of a situation. I fully agree with Arizona Senate Bill 1070. The tax payers in the United States will end up paying for them to be here when they get on welfare. I think all the states need to create and implement the same bill. Something needs to be done. There are legal ways for them to enter our country and they ignore the laws and enter any way they can.
